Pella Corporation (“Pella,” “we,” “us,” and “our”) understands that privacy is important to you.  This privacy policy (“Policy”) describes the information we collect from or about you through the Pella-owned websites (collectively, “Site”) on which it is posted. It describes how we use and share that information and describes the steps we take to protect your privacy.

This Policy applies only to information collected through this Site. It does not apply to third-party websites or third-party mobile apps. It also does not apply to information collected through other channels, such as over the phone or in person.

For example, certain pages of our Site may contain Privacy Notices providing more details about the information we collect on those particular pages, why we need that information, and choices you may have about the ways we use that information. What Information Do We Collect

We do not collect personal information about you unless you voluntarily submit that information to us, such as through our contact pages, by e-mail, registering an account with us or some other means. The personal information which you may provide to us could include your name, address, telephone number, e-mail address, and credit card information.

When you visit or use the Site, we may automatically collect certain non-personal information about you, such as the type of browser or device operating system you use, the domain name of the website from which you linked to us, the amount of time you spend on the Site and the pages on the Site that you view. We may also aggregate information collected from our users (such as the number of users in a particular region or having particular characteristics).

How We Share Your Information

With Third-Party Vendors
Pella shares information collected through this Site with third-party vendors who act for us or on our behalf. For example, we may use third-party vendors to design and operate this Site; to conduct surveys; and to help us with our promotional efforts. These third-party vendors may need information about you to perform their functions.  

With Other Users of this Site
You may be able to submit User-Generated Content on or through this Site. In this Policy, “User-Generated Content” or “UGC” refers to any content that you post using the social networking or product review tools we make available to you and that does not constitute “Feedback” (as that term is defined in our Terms of Use.  Any personal information contained in UGC can be read, collected, or used by others. In addition, we may use UGC you submit for advertising campaigns and other promotions. We may or may not use your name in connection with such use, and we may or may not seek your consent before using the content for such purposes. Therefore, you should have no expectation of privacy with respect to UGC you submit on or through this Site.

With Third-Party Social Media Platforms
We may provide functionality on this Site that allows you to automatically post information about the actions you take on this Site to a third-party social media platform (such as Facebook or Twitter). If you choose to take advantage of this functionality, people with access to your profile on the third-party platform may be able to see the actions you have taken – for example, the items you have purchased. Thus, you should have no expectation of privacy in those actions. Further, if you choose to link your profile on this Site with an account on a third-party social media platform, we may share the information in your profile with that third-party platform.

With Our Distributors, Licensees and Other Affiliates
Pella may share the information collected through this Site with its affiliates, licensees and independent distributors (collectively “distributors”). Our distributors may use the information in all the ways listed in this policy, provided that such use relates to products or services authorized by Pella. For example, if you request an appointment, we will need to share your information with a Pella expert near you to schedule an appointment. Our distributors may also use your information for their own marketing purposes, provided such marketing relates to products or services authorized by Pella – they may not use your information to promote competing windows or doors or other, products or services not authorized by Pella.

With Business Partners
From time to time, we may share your information with selected third parties (other than our third-party vendors or distributors) for joint marketing purposes.

As Part of a Business Transfer
Your information may be transferred to successor organization if, for example, we transfer the ownership or operation of this Site to another organization or if we merge with another organization. If such a transfer occurs, the successor organization’s use of your information will still be subject to this Policy and the privacy preferences you have expressed to us.  

To Comply with Laws and Protect Our Rights and the Rights of Others
We may disclose your information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. We may also disclose your information to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of this Site; to enforce or apply our online Terms of Use or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others. We reserve the right to disclose your information as described in any Privacy Notice posted on a page of this Site where you provide that information. By providing your information on that page you will be consenting to the disclosure of your information as described in that privacy notice. We also reserve the right to disclose your information as described in any click-through agreement to which you have agreed.

How We Collect Your Information

Information You Manually Provide
Pella collects the information you manually provide (using your keyboard, mouse, or touchpad) when you use this Site, for example, we collect the information you provide when you request an appointment, literature, or services, or when you e-mail us with questions or feedback.  

Information from Third-Party Social Media Platforms
You may be able to register with, log on to, or enhance your profile on this Site by choosing to automatically populate the requested data fields with information you previously provided to a third-party social media platform (such as Facebook or Twitter). By doing this, you are asking the third-party platform to send us information from your profile on that platform. We treat that information as we do any other information you give to us when you register, log on, or enhance your profile.  

Information Sent to Us by Your Web Browser
Pella collects information that is sent to us automatically by your web browser. This information typically includes the IP address of your Internet service provider, the name of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. The information we receive depends on the settings on your web browser. Please check your browser if you want to learn what information your browser sends or how to change your settings.

The information we receive from your web browser is not, in and of itself, personally identifiable. Generally, we use this information to help us improve this Site (for example, by making it more compatible with the technology used by our visitors) and to improve our marketing efforts (for example, by identifying your general geographic location). However, we may combine it with other information in an attempt to identify you or we may combine it with information that does identify you. We may also review our server logs for security purposes – for example, to detect intrusions into our network – and we might share our server logs, which contain visitors’ IP addresses, with the appropriate investigative authorities who could use that information to trace and identify you.

More about IP addresses
Your IP address is the identifier assigned to your particular computer or other device when you access the Internet. Depending on how you connect to the Internet, your IP address may always be the same, or it may change each time you access the Internet. IP addresses do not include your name, email address or other personal information, but in some cases, they may be linked to your personal information. For example, if you have registered with this Site, we may link your IP address to account information that identifies you personally. We may also provide your IP address to our third-party service providers who can use it to identify information such as your state and zip code. If we suspect inappropriate or criminal activity or a threat to our Sites or their users, we may also share our server logs – which contain users’ IP addresses – with the appropriate investigative authorities, who could use that information to trace and identify individuals.  

Clickstream Data
As you use the Internet, a trail of electronic information is left at each website you visit. This information, which is sometimes referred to as “clickstream data,” can be collected and stored by a website’s server. Clickstream data can tell us the type of device and browsing software you use and the address of the website from which you linked to the Site. We may collect and use clickstream data to anonymously determine how much time visitors spend on websites, how visitors navigate throughout websites and how we may tailor our Site to better meet consumer needs. This information will be used to improve our Site and our services. Any collection or use of clickstream data will be anonymous, and will not intentionally contain any personal data.

Pella Insynctive Products
Connecting Pella Products with Third Party Products: If you are using certain Pella products, such as those featuring Pella’s Insynctive technology, these products can communicate directly or indirectly through third party devices and software (“Affiliate Devices”). Our technology acts as a bridge between our products and Affiliate Devices. Through our Insynctive products, Affiliate Devices may collect certain personal and non-personal information, including, product usage data, and general location based information. These third parties may share information they collect about you with us but we are not responsible for their data collection practices. We urge you to review their privacy policies to better understand their processing of your data. Data collected through our App by third parties help us and our partners better understand how our consumers are using our products and how to improve our products.

Interest Based Advertising

We may ourselves, or with third party vendors, use non-personal information in connection with our own or vendor information to deliver targeted advertising to you when you visit other websites or our Site. Cookies, clickstream data, and other similar technologies described above may be used in this process. For example, if you are searching for information on a particular product, we or our vendor may cause an advertisement to appear on other websites you view with information on that product. This form of advertising, sometimes called “behavioral advertising,” is based on anonymous information and not on any personal information. As a result, we and our vendor know your interests, but do not personally identify you in connection with the delivery of that specific ad. Opting Out of Interest Based Advertising
The online advertising industry provides a service through which you may opt-out of receiving targeted ads from certain data partners and other advertising partners that participate in self-regulatory programs.  We comply with the Self-Regulatory Principles for Online Behavioral Advertising set forth by the Digital Advertising Alliance (DAA). You can opt-out of targeted advertising from certain providers at www.aboutads.info/consumers. You can opt-out of targeted advertising from certain providers at www.aboutads.info/consumers. Please note that by opting out, you will continue to see generic advertising that is not tailored to your specific interests and activities. To be clear, cookie-based opt-outs must be performed on each device and browser that you wish to have opted-out. For example, if you have opted out on your device browser, that opt-out will not be effective on your mobile device. You must separately opt out on each device.

Because of the changing state of technology and indecision within the industry regarding the meaning of DNT signals, we currently do not make any guarantee that we will honor DNT signals.

Pella takes reasonable precautions to provide a level of security appropriate to the sensitivity of the information we collect. Although we use reasonable measures to help protect your information against unauthorized use or disclosure, due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information provided online. Therefore, we cannot guarantee the security of information provided over the Internet or stored in our databases and will not be responsible for breaches of security beyond our reasonable control.


Retention of Personal Information

Pella retains the personal information collected on this Site as long as necessary to provide the services, products and information you request or as permitted by applicable law. Even if we delete some or all of your personal information, we may continue to retain and use aggregate or anonymous data previously collected and/or anonymize or aggregate your personal information. Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.

A Note About Children’s Privacy

You must be at least 18 years old to have our permission to use this Site. We do not knowingly collect, use or disclose personal information about visitors under 13 years of age. If you are under the age of 13, you can use this service only in conjunction with your parent’s or guardian’s permission.

Pella is a United States corporation. The servers that support this Site may be located in the United States or other countries. Data protection laws vary from country to country; however, we will process your information in accordance with this Policy no matter where your data is stored. By using the Site, you freely and specifically give us your consent to export your personal information to the United States and to store and use it in the United States as specified in this Policy.  You understand that data stored in the USA may be subject to lawful requests by the courts or law enforcement authorities in the USA.

Changes to the Policy

We reserve the right, at our discretion, to change, modify, add, or remove portions from this Policy at any time.  However, if at any time in the future we plan to use personal information in a way that materially differs from this Policy, we will post such changes here or email you. Consumer Supplemental Privacy Policy

This Supplemental Privacy Policy and Notice (“Supplemental Policy”) applies only to information collected about consumers residing in California, Colorado, Virginia, Utah, or Connecticut (“consumer(s),” “Consumer(s),” “you,” “your”) and supplements the information contained our primary Privacy Policy. It provides information required under the California Consumer Privacy Act of 2018 and as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”), the Colorado Privacy Act of 2021 (the “CPA”), the Virginia Consumer Data Protection Act of 2021 (the “VCDPA”), the Utah Consumer Privacy Act of 2022 (the “UCPA”), and the Connecticut Data Privacy Act of 2022 (“CDPA”) and any and all regulations arising therefrom.

This Supplemental Policy describes the practices of Pella Corporation and its subsidiaries’ (“Pella,” “we,” “us,” or “our”) regarding the collection, use, and disclosure of personal information and provides instructions for submitting data subject requests. Some portions of this Supplemental Policy apply only to consumers of particular states, and we have indicated where those portions are state-specific.

Definitions Specific to this Policy

“Consumer” means a natural person who resides in California, Colorado, Virginia, Utah and Connecticut and to whom we offer information, goods, or services. For purposes of this Supplemental Policy, this term includes natural persons who reside in California and engage with us as part of business-to-business transactions.

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or household. Personal Information includes “personal data” as that term is defined in the CPA, VCDPA, UCPA, and CDPA. Personal Information also includes “Sensitive Personal Information,” as defined below.

“Sensitive Personal Information” means Personal Information that reveals a Consumer’s: 1) Social security, driver’s license, state identification card, or passport number; 2) Account log-in, financial account number, debit card number, or credit card number in combination with any required security or access code, password, or credentials allowing access to the individual’s account; 3) Precise geolocation; 4) Racial or ethnic origin; 5) Religious beliefs; 6) Union membership; 7) Contents of email or text messages, unless we are the intended recipient; 8) Genetic data; 9) Biometric information used to uniquely identify the Consumer, and 10) Health, sex life, or sexual orientation. Sensitive Personal Information includes “sensitive data” as that term is defined in the CPA, VCDPA, UCPA, and CDPA.

“Sell,” “Sale,” or “Sold” means renting, releasing, or transferring an individual’s Personal Information to a Third Party for money or other valuable consideration.

Share,” “Shared,” or “Sharing” means transferring an individual’s Personal Information to a Third Party for behavioral advertising purposes, whether or not for money or other valuable consideration.

“Third Party” means a person or organization which is not a Consumer, Vendor, or an entity owned or controlled by us and as defined by the CCPA, CPA, VCDPA, UCPA, and CDPA.

“Vendor” means a “service provider,” “contractor,” or “processor” which collects, stores, or otherwise handles data for us, as those terms are defined in the CCPA, CPA, VCDPA, UCPA, and CDPA.

These definitions apply, whether terms are capitalized or not. Other terms used in this Supplemental Policy may be defined under the CCPA, CPA, VCDPA, UCPA, or CDPA, and they shall have the meanings described in those statutes. If there are variations between such definitions in different laws, you will be covered by the definition that applies in your state. For example, if you are a Virginia consumer, terms defined in the VCDPA shall apply to you if they are used in this Supplemental Policy.

Your Rights to Your Personal Information

California, Colorado, Virginia, Utah, and Connecticut consumers have certain rights with respect to the collection and use of their personal information. Those rights vary by state. As required by the CCPA, we provide detailed information below regarding the data subject rights available to California consumers. Consumers in Colorado, Virginia, Utah, and Connecticut have similar rights and can find more detail by referencing the CPA, VCDPA, UCPA, or CDPA, as applicable.

You have the right to submit requests related to the personal information we have collected about you. You may make such a request twice in a 12-month span. Please note, there are circumstances when we may not be able to comply with your request. For example, we may not be able to verify your request, or we may find that providing a full response conflict with other legal obligations or regulatory requirements. We will notify you if this is the case.

Right to Receive Information on Privacy Practices.

You have the right to receive the following information at or before the point of collection:

  • The categories of personal information to be collected;
  • The purposes for which the categories of personal information are collected or used;
  • Whether or not that personal information is sold or shared with Third Parties or disclosed to Vendors;

Right Know and Right to Access.

You have the right to request certain information we have collected about you. You have the right to request:

  • Specific pieces and categories of personal information we collected about you;
  • The categories of sources from which personal information was collected;
  • The purposes for which personal information was collected, shared, sold, or processed;
  • The categories of personal information we shared, sold or disclosed; and
  • The categories of Vendors or Third Parties with whom we shared, sold or disclosed personal information.

Right to Delete.

You have the right to request that we delete certain personal information that we have collected.

Right to Correct.

You have a right to request that we correct any inaccurate personal information we may retain about you.

Right to Opt-Out of the Sale and Sharing of Your Personal Information.

You have the right to opt-out of the sale and sharing of your personal information with Third Parties, and the right to opt out of the processing of personal information for targeted advertising purposes, as defined in the CCPA, CPA, VCDPA, UCPA, and CDPA.

SELL/SHARE/PROCESS PERSONAL INFORMATION

We sell and share personal information, or process personal information for targeted advertising purposes. In the past 12 months, we have sold or shared the categories of consumer personal information as listed in this Supplemental Policy. As a consumer, you have the right to opt-out of the sale and/or sharing of your personal information and of the processing of personal information for the purpose of targeted advertising. To submit an opt-out request, please access the below link or follow the “Instructions to Exercise Your Rights,” below. We do not knowingly sell or share personal information of consumers under 16 years of age.

Update Contact Preferences: “Do Not Sell or Share My Personal Information”

If you opt-out of the sale of your personal information, we will wait at least 12 months before asking you if we may sell or share your personal information.

You have the right to opt-in to the sale of your personal information after you have opted out. If you would like to opt-in to the sale or sharing of your personal information, please email us at privacy@pella.com or call us at 1-800-728-1017. Opting-in is a two-step process in which you will first clearly request to opt-in, and then separately confirm that choice.

Right to Consent to or Limit the Use of Your Sensitive Personal Information.

You have the right to consent to the use of your Sensitive Personal information in CO, CT, VA and UT. Separately, you have the right in CA to instruct us to limit the use and disclosure of your Sensitive Personal Information to only that which is necessary to perform the services or provide the goods reasonably expected by an average consumer or for specific business purposes defined by law.

USE SENSITIVE PERSONAL INFORMATION OTHER THAN AS LISTED IN THE CCPA:

We use Sensitive Personal Information with your consent, and for the purposes listed in Section D. In CA, you have the right to further limit the use of your Sensitive Personal Information to the purposes authorized by the CCPA. Right to Non-discrimination.

You have a right to exercise the above rights, and we will not discriminate against you for exercising these rights. Please note that a legitimate denial of a request to access, delete, or opt-out is not discriminatory, nor is charging a fee for excessive or repetitive requests.

The link will take you to an interactive webform that you can complete and submit to make a request for information that we will then verify. If you use the telephone number, you will be guided through a process that will allow you to submit a verifiable request, and the level of verification will depend on the request being submitted. You may also submit a request by emailing us at privacy@pella.com.

You may designate an authorized agent to exercise your rights under the CCPA on your behalf. Such individual must have power of attorney, or be an authorized agent registered with the relevant Secretary of State.

Right to Appeal for California, Virginia, Colorado, and Connecticut Consumers.

You have the right to appeal our decisions about your data subject requests. If you choose to appeal, your request will move from Operations to our Legal Department for review. If you would like to appeal a decision regarding your data request, please click Update Contact Preferences or call 1-800-728-1017. Please state that your request is an “Appeal,” and describe the date and nature of your original request.

Verification Process

When you submit a request to exercise your data subject rights, we may ask you to provide information that will enable us to verify your identity.

If you designate an authorized agent to exercise your rights on your behalf, we may require that you or the authorized agent do the following:

  • Verify your identity with us directly.
  • Provide proof of your signed written permission for the authorized agent to submit a request on your behalf.

We may deny a request from an agent purportedly acting on your behalf if we request, and the agent does not submit, proof that he, she, or it has been authorized by you to act on your behalf.

Personal Information of Minors

Our online content is not intended for children or minors under the age of sixteen years. Accordingly, we do not knowingly store information from minors under the age of sixteen years, except as required by applicable law. Additional California Privacy Rights

Shine the Light Request. California Civil Code Section § 1798.83 permits users of our website who are California residents to request information about our disclosure of personal information to other parties for their direct marketing purposes. Financial Incentives for California Consumers/Contractors

Under California law, we may provide financial incentives to California Business to Business contractors (defined as Product Dealers, Installers, and Service Professionals) who allow us to collect, retain, or share personal information collected from Consumers on Pella’s behalf. These contractors may receive incentives that may include monetary payments, program rewards, and/or a higher level of goods or services.

Changes to Our Supplemental Policy

Pella reserves the right to amend this Supplemental Policy at our discretion and at any time. When we make changes to this Supplemental Policy, we will post an updated policy on our website with the effective date.
